1. Terms of Service
1. Acceptance of Terms

By visiting our website, booking consultations, or using any of our coaching or consulting services (the “Services”), you agree to these Terms of Service, our Privacy Policy, Cookie Policy, and Refund Policy. If you disagree, please discontinue use immediately.

2. Eligibility

You must be 18 years or older (or the age of majority in your jurisdiction) and capable of forming a binding contract.

3. Scope of Services
  • Executive Leadership Coaching: personalized 1:1 and group coaching to develop authentic leadership.

  • Management Consulting: strategy, transformation, partnerships, sales enablement, culture, and organizational design.

  • Leadership Transition / Fractional C-Suite: interim or fractional executive roles (CEO, COO, Growth Officer, etc.).

  • Sportspreneurs Division: guidance for athlete entrepreneurs and NIL business education (not legal/agent services).

Engagement details are defined in the applicable proposal, SOW, or MSA.

4. No Guarantees

We provide tools and guidance but do not guarantee outcomes or results.

5. Payments & Taxes

Fees are due at booking or as stated in your agreement. All prices exclude applicable taxes. You authorize us to charge your selected payment method.

6. Cancellations & Refunds

See the Refunds & Cancellations Policy below (incorporated by reference).

7. Intellectual Property

All content, frameworks, and materials are owned by Activate International or its licensors. You receive a limited license for personal/internal use only. No redistribution, resale, or derivative works without written consent.

8. Confidentiality

Both parties agree to protect confidential information shared during any engagement and to use it solely for performance of the Services.

9. Testimonials & Publicity

We may reference your testimonial or logo only with your written consent. You may revoke consent at any time by emailing tanya@activateintl.com.

10. Acceptable Use

You agree not to misuse the site, interfere with systems, or engage in unlawful or abusive behavior.

11. Third-Party Links

External links are provided for convenience. We are not responsible for third-party sites or terms.

12. Disclaimers

Services are provided “as is.” We disclaim all warranties, express or implied.

13. Limitation of Liability

Our total liability will not exceed the fees you paid in the three (3) months preceding the claim. We are not liable for indirect or consequential damages.

14. Indemnification

You agree to indemnify and hold harmless Activate International from claims arising out of your use of our Services or breach of these Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules.
Unresolved matters will be exclusively and confidentially arbitrated in Palm Beach County, Florida before a single arbitrator under the American Arbitration Association (AAA) rules.
Judgment on the award may be entered in any court of competent jurisdiction. Class actions are waived to the extent permitted by law.

16. Changes

We may update these Terms periodically. Continued use constitutes acceptance.

2. Privacy Policy
1. Information We Collect
  • You provide: name, email, phone, company, billing data, documents, and messages.

  • Automatically: IP address, device ID, browser type, analytics, and cookies.

  • From third parties: payment processors, booking tools, CRM, and marketing partners.

2. How We Use Information

To provide and improve Services, schedule sessions, process payments, communicate with you, analyze usage, and comply with law.

3. Legal Bases (EEA/UK)

Contract performance, legitimate interests, consent (where required), and legal obligations.

4. Sharing of Data

We share with trusted service providers, professional advisors, or as required by law. We never sell personal information.

5. Retention & Security

We retain data only as long as necessary and apply reasonable administrative, technical, and physical safeguards.

6. Your Rights

Depending on your location, you may request access, correction, deletion, or restriction by emailing tanya@activateintl.com.

7. Children

We do not knowingly collect data from children under 13 (16 in EEA).

8. International Transfers

Data may be stored in or transferred to the USA. We use lawful transfer mechanisms when required.

9. Updates

We may revise this Privacy Policy periodically. Changes take effect upon posting.

4. Refunds & Cancellations Policy
1:1 Coaching
  • Cancel/reschedule ≥ 24 hours before: no fee.

  • Cancel/reschedule < 24 hours or no-show: fee forfeited.

Group Cohorts & Workshops
  • Non-refundable once a cohort begins.

  • Deferrals may be granted subject to availability.

Consulting / Fractional Engagements
  • Governed by SOW/MSA. Retainers and work performed are non-refundable.

  • Either party may terminate for material breach per agreement.

Force Majeure

Neither party is liable for delays beyond reasonable control.

5. Professional Services Disclaimer

Our Services are for educational and developmental purposes only and are not medical, legal, financial, or tax advice. You are responsible for your own decisions and actions.
 

6. Accessibility Statement

Activate International aims to comply with WCAG 2.1 AA standards.

When acting as a Processor for corporate clients, Activate International will:

  • Process data only per client instructions.

  • Notify of data breaches without undue delay.

  • Delete or return data at termination.
